BATTERY TESTING TERMS & DISCLAIMER

These Terms & Disclaimer apply to all battery health assessments and reports provided by CDE Automotive Pty Ltd trading as EV Chargecheck, including assessments performed using AVILOO, vsNEW or other diagnostic equipment or testing platforms.
1. Nature of the Battery Test
EV Chargecheck provides independent battery health assessments intended to provide information about the apparent condition of a vehicle's battery at the time of testing.
A Battery Health Report is a point-in-time assessment only. Battery condition can change after testing, and faults or deterioration may occur at any time.
2. No Warranty or Guarantee
A Battery Health Report is not a warranty or guarantee of the future condition, performance, capacity, range, reliability or service life of a vehicle's battery.
EV Chargecheck does not guarantee that:
a battery will remain in the condition recorded in the report;
a battery will not subsequently deteriorate or fail;
a particular State of Health or capacity will be maintained;
a vehicle will achieve a particular driving range; or
a fault will not develop after testing.
A satisfactory test result does not guarantee that a battery will not subsequently develop a fault or fail.
3. Testing Limitations
Battery testing is performed using the diagnostic equipment, software and methodology available for the particular vehicle.
Different testing platforms, including AVILOO and vsNEW, may use different methodologies and calculations. Results should therefore be considered in the context of the testing method used.
The test may not identify every existing, intermittent or future battery fault.
Unless specifically stated otherwise, the Battery Test does not involve opening, dismantling or physically inspecting the internal components of the high-voltage battery.
4. Not a Complete Vehicle Inspection
A Battery Health Report relates specifically to the battery assessment performed.
It is not a comprehensive mechanical inspection, pre-purchase inspection, roadworthiness inspection, safety certificate, engineering inspection or manufacturer's inspection.
Customers should obtain any additional vehicle inspections or professional advice they consider appropriate.
5. Vehicle Range and Battery Life
EV Chargecheck does not guarantee a vehicle's future driving range or battery life.
Actual range and battery performance can be affected by factors including temperature, driving conditions, speed, vehicle load, tyre condition, charging history, battery temperature, software and other operating conditions.
6. Purchasing or Selling a Vehicle
The Battery Health Report is provided to assist the customer in making their own informed decision.
EV Chargecheck does not advise or guarantee that a customer should purchase, sell or retain a particular vehicle.
The customer remains responsible for considering the report together with the vehicle's history, mechanical condition, service history and any other relevant information.
7. Limitation of Liability
To the maximum extent permitted by law, EV Chargecheck is not responsible for loss or damage arising from future battery deterioration, battery failure, vehicle failure, repair costs, replacement costs, loss of vehicle use, loss of value or other consequential loss occurring after the Battery Test.
Nothing in these Terms excludes, restricts or modifies any right, guarantee, remedy or liability that cannot legally be excluded under Australian law.
8. Australian Consumer Law
Nothing in these Terms is intended to exclude or limit the customer's rights under the Australian Consumer Law or any other applicable legislation where those rights cannot legally be excluded.
Our services come with guarantees that cannot be excluded under the Australian Consumer Law.
9. Customer Acknowledgement
By requesting or proceeding with a Battery Health Test, the customer acknowledges that:
The Battery Health Report is a point-in-time assessment only. It is not a warranty or guarantee of future battery condition, performance, range or service life. Battery condition can change and faults can develop after testing.
